Terms of Service
Last updated: October 12, 2026
1. Introduction
HILNA operates the HILNA platform, which includes the mobile application, the web portal at my.kinesia.app, the patient portal at patient.kinesia.app, and related services (collectively, the "Service").
By accessing or using HILNA, you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.
2. Service Description
HILNA is a practice management platform designed for physiotherapists, chiropractors, osteopaths, and other rehabilitation professionals. Core features include:
- Exercise program creation and management
- AI-assisted program generation from clinical notes
- Exercise video recording and library management
- Patient portal for program delivery and progress tracking
- Clinic branding and customisation
- Team management and multi-clinician collaboration
HILNA is not a medical device. The Service is not intended to diagnose, treat, cure, or prevent any disease or medical condition. HILNA is not a substitute for professional clinical judgment, and it is not regulated under medical device legislation in any jurisdiction.
3. Account Registration
To use HILNA, you must create an account and provide accurate, complete information during registration. You are responsible for:
- Maintaining the accuracy of your account information
- Keeping your account credentials secure and confidential
- All activity that occurs under your account
Accounts are for individual use only. Each person must have their own account, and accounts may not be shared with or transferred to another person.
Professional standing: HILNA is a professional tool for physiotherapists, chiropractors, osteopaths, and other regulated health professionals using it in professional practice. By creating an account, you confirm that you are appropriately licensed or registered in your jurisdiction and entitled to provide care to your patients. HILNA is not a consumer health app.
4. Subscription & Billing
New accounts receive a 30-day free trial with full access to all features. No payment information is required during the trial.
After the trial period, a paid subscription is required to continue creating new content (programs, exercises, templates). Your existing data — including programs, patient records, and patient portal access — remains fully accessible without a subscription.
Subscriptions are billed monthly or annually through Stripe. Current prices are listed on the subscription page at my.kinesia.app.
Auto-renewal: Subscriptions renew automatically at the end of each billing period. You can cancel your subscription at any time through the subscription management portal at my.kinesia.app. When you cancel, your access to paid features continues until the end of your current billing period.
Price changes: HILNA may change subscription pricing with at least 30 days' notice. If you are an active subscriber at the time of a price change, your current rate will remain in effect until you cancel or your billing period renews after the notice period has elapsed.
Refunds: We do not offer refunds for partial billing periods. However, we may make exceptions at our discretion for reasonable requests. Contact us at hello@hilna.app if you believe a refund is warranted.
Apple iOS: the mobile app does not sell subscriptions in-app. Subscriptions are purchased, changed, and cancelled on the web, through the subscription management portal described above.
5. Acceptable Use
When using HILNA, you agree not to:
- Share your account credentials with others or allow unauthorised access to your account
- Use the Service for any illegal purpose or in violation of any applicable laws
- Attempt to reverse engineer, decompile, or disassemble any part of the Service
- Upload malicious content, including viruses, malware, or other harmful files
- Interfere with or disrupt the Service's infrastructure or other users' access
- Exceed reasonable usage patterns, including automated account creation, excessive API calls, or scraping
You must not use HILNA to store information about minors without appropriate parental or guardian consent as required by applicable law in your jurisdiction.
6. Data Ownership & Licence
You retain full ownership of all content you create using HILNA, including exercise programs, clinical notes, video recordings, exercise templates, document attachments, and patient data.
By using the Service, you grant HILNA a limited, non-exclusive licence to process, store, and transmit your content solely for the purpose of providing and maintaining the Service. This licence ends when you delete your content or your account.
HILNA does not sell your data, use it for advertising, or share it with third parties except as necessary to operate the Service (see our Privacy Policy for details).
Third-party demonstration videos embedded from other platforms are not covered by this section. They remain the property of their owners, are governed by the terms of the platform hosting them, and HILNA grants you no rights over them.
7. AI-Generated Content
HILNA uses artificial intelligence (powered by Anthropic Claude) to generate exercise programs, patient education documents, and related clinical content.
AI-generated content is a clinical suggestion, not medical advice. You are solely responsible for reviewing, modifying, and approving all AI-generated output before prescribing it to patients. You should exercise the same professional judgment with AI-generated content as you would with any other clinical resource.
When clinical notes are sent to the AI for program generation, they are anonymised before submission. No patient names, identifiers, or personal information are included in AI requests. The AI receives only clinical observations, body regions, and exercise preferences.
AI-generated content may contain errors, omissions, or clinically inappropriate suggestions. HILNA is not liable for any clinical outcomes resulting from the use of AI-generated content.
Your responsibility is not limited to AI-generated content. HILNA supports your clinical work; it does not practise physiotherapy and does not provide medical advice. You remain solely responsible for all clinical decisions, including whether any program — however it was produced — is appropriate for a given patient and their condition.
8. Patient Data
As a clinician using HILNA, you are responsible for obtaining any consent required by applicable law from your patients before entering their personal information into HILNA and sharing exercise programs with them.
Patient data entered by clinicians — including patient names, email addresses, and phone numbers — is used solely for the purpose of delivering exercise programs and related communications (such as reminders and progress notifications).
Patients access their exercise programs through a secure portal using one-time email verification codes. No patient accounts or passwords are created.
Your role and ours under health privacy law. You are the health information custodian for your patients’ information under applicable privacy law, including Ontario’s Personal Health Information Protection Act (PHIPA). HILNA acts as your agent and electronic service provider, and processes patient information only on your behalf and on your instructions. Where a Clinic Data-Handling Agreement is in place between HILNA and your clinic, that agreement sets out the detailed handling terms and applies in addition to these terms; our Privacy Policy describes the processing in either case.
HILNA is a supplementary tool, not your system of record. HILNA helps you deliver home exercise programs. It is not your clinical record of record, and it must not be relied on to meet your record-retention obligations. You remain responsible for maintaining your own clinical record in your primary record-keeping system, including retaining records for as long as your College or other regulator requires.
9. Availability & Support
HILNA aims to maintain high availability of the Service but does not guarantee uninterrupted or error-free operation. The Service may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control.
Where possible, scheduled maintenance will be communicated in advance. We will make reasonable efforts to minimise disruption.
Support is available via email at hello@hilna.app.
10. Limitation of Liability
The Service is provided on an "as is" and "as available" basis, without warranties of any kind, whether express or implied, including but not limited to implied warranties of merchantability, fitness for a particular purpose, and non-infringement.
To the maximum extent permitted by applicable law, HILNA's total aggregate liability to you for any claims arising out of or related to the Service is limited to the total amount you paid to HILNA in the twelve (12) months immediately preceding the event giving rise to the claim.
HILNA is not liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, loss of profits, or damages arising from clinical outcomes, even if HILNA has been advised of the possibility of such damages.
11. Indemnity
You agree to indemnify HILNA against any third-party claim, and any loss or reasonable legal cost arising from it, to the extent the claim arises from:
- your use of the Service in breach of these terms or of any applicable law;
- the clinical decisions you make and the care you provide, including your use of any program or document delivered through the Service;
- content you enter into or upload to the Service that you did not have the right to enter or upload; and
- your failure to obtain a patient consent that applicable law requires.
This does not apply to the extent that the claim arises from HILNA’s own breach of these terms, negligence, or wilful misconduct.
If we seek indemnity, we will notify you promptly, and you may direct the defence of the claim with counsel of your choosing. We may participate at our own expense. You may not settle a claim in a way that admits fault on HILNA’s behalf, imposes an obligation on HILNA, or requires HILNA to make a payment, without our prior written consent.
12. Account Termination & Deletion
You may delete your account at any time from the mobile app or web portal. Account deletion permanently removes your login, your profile, your private exercises, exercise templates and library programs, and your clinic if you are its only member. Programs you created for patients are kept, together with each patient's record, attachments and progress updates, so your patients can keep opening the programs you sent them. They are no longer linked to you, and their reminder emails stop. Content you shared with your clinic or the HILNA community also stays available. The full list is on our Delete your account page.
HILNA may suspend or terminate your account if you violate these terms or abuse the Service. Where practicable, we will provide notice before termination.
Following termination or deletion, your data is retained for 30 days before permanent deletion to allow for reconsideration. After the 30-day retention period, all data is permanently and irreversibly removed.
A patient can delete their data, and this also removes your copy. A patient may ask HILNA to permanently delete the data held about them — either directly through the patient portal, or through a deletion invitation you send them from the app. The patient authenticates and confirms the deletion themselves; you cannot delete a patient’s data on their behalf. When a deletion completes, the programs, exercise videos, progress history, and documents you delivered to that patient through HILNA are permanently removed — including your own copy — and HILNA cannot retain them for you. Your exercise library and templates are not affected: they are your own content, and only that patient’s delivered content is removed.
Because HILNA is a supplementary tool and not your system of record, as described under Patient Data above, save anything you are required to keep to your own clinical record before a deletion completes. HILNA emails you after a patient deletion completes so that you can confirm your own record is complete. Where a Clinic Data-Handling Agreement is in place, its patient-initiated deletion provisions apply in addition to this section and are consistent with it.
13. Modifications
HILNA may update these Terms of Service from time to time. When we make material changes, we will notify you via email at the address associated with your account.
Your continued use of the Service after receiving notification of changes constitutes acceptance of the updated terms. If you do not agree with the changes, you should stop using the Service and delete your account.
14. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.
Any disputes arising out of or in connection with these terms shall be submitted to the exclusive jurisdiction of the courts located in the Province of Ontario, Canada.
